TITLE III. Alternative Obligations.

Section 147.
  • If the prestation is to be selected from among several prestations, the obligation is said to be alternative.

  • The right of selection is presumed to belong to the debtor.

  • If the selection is to be made within a period of time, and the party who has the right of selection does not exercise it within such period, the right of selection passes to the other party.

  • [I] If no period of time was fixed, the party who has not the right of selection can notify the other party to exercise his right of selection within a reasonable time, to be fixed in such notice.
