Chapter II. Bill of Exchange.
Part V. Suretyship.
Section 1036.
- Every party to a bill of exchange may be guaranteed by a surety.

- Suretyship is created by a signed statement to that effect on the bill of exchange.

Section 1038.
- A person who not being the drawee merely puts his signature on the face of a bill of exchange is deemed to be a surety.

- Suretyship may be for part only of the amount of the bill of exchange.

- If the surety does not state on the bill of exchange for whom he is surety, he is deemed to be surety for the drawer.

- A surety who has performed his obligation is subrogated to the rights which the holder had against the guaranteed debtor and to the rights of such debtor against the prior parties.
