Part III. Promise of Sale.
Section 461.
- [I] A promise of sale is a contract whereby one party agrees to sell or to buy a property, and the other party agrees that he will at his discretion either complete or not complete the sale.
- [II] [บุคคลฝ่ายที่ได้ทำคำมั่นให้นั้น ชื่อว่าเปนผู้ให้คำมั่น และคำมั่นนั้นทำให้แก่ผู้ใด ผู้นั้นชื่อว่าเปนผู้รับคำมั่น]

Section 462.
- If the other party notifies his intention to complete the sale, the promise of sale has the effect of a contract of sale as soon as the notification reaches the first party.

Section 463.
- [I] If no time is fixed for the notification, the party who made the promise can fix a reasonable time and call upon the other party to answer within that time whether he will complete the sale or not.
- [II] If he does not answer within that time, the contract is extinguished.
