มาตรา 440
  • ถ้าศาลยกคดีเสียเพราะเหตุคดีไม่อยู่ในอำนาจศาล และกำหนดอายุความสิ้นไปแล้วในระหว่างพิจารณาก็ดี ฤๅจะสิ้นลงในระหว่างหกเดือนภายหลังที่ได้พิพากษาคดีถึงที่สุดก็ดี ให้ขยายอายุความนั้นออกไปถึงหกเดือนภายหลังคำพิพากษานั้น
