มาตรา 39
  • สภาพบุคคลย่อมเริ่มแต่เมื่อคลอดแล้วอยู่รอดเป็นทารก และสุดสิ้นลงเมื่อตาย
  • ทารกในครรภ์มารดา สามารถจะมีสิทธิบางอย่างที่กฎหมายบ่งไว้โดยเฉภาะ หากว่าภายหลังเกิดมารอดอยู่
