มาตรา 1071
- ในกรณีที่กล่าวไว้ใน มาตรา ๑๐๗๐ นั้น ถ้าผู้เปนหุ้นส่วนนำพิสูจน์ได้ว่า
- (๑) สินทรัพย์ของห้างหุ้นส่วนยังมีพอที่จะชำระหนี้ได้ทั้งหมดฤๅบางส่วน และ
- (๒) การที่จะบังคับเอาแก่ห้างหุ้นส่วนนั้นไม่เปนการยากฉนี้ไซร้
- ศาลจะบังคับให้เอาสินทรัพย์ของห้างหุ้นส่วนนั้นชำระหนี้ก่อนก็ได้ สุดแต่ศาลจะเห็นสมควร
