- ถ้าธนาคารเขียนข้อความลงลายมือชื่อบนเช็ค เช่นคำว่า "ใช้ได้" ฤๅ"ใช้เงินได้" ฤๅคำใด ๆ อันแสดงผลอย่างเดียวกัน ท่านว่าธนาคารต้องผูกพันในฐานเปนลูกหนี้ชั้นต้นในอันจะต้องใช้เงินแก่ผู้ทรงตามเช็คนั้น
