* ถ้าลูกจ้างเป็นผู้ซึ่งนายจ้างได้จ้างเอามาแต่ต่างถิ่นโดยนายจ้างออกเงินค่าเดินทางให้ไซร้ เมื่อการจ้างแรงงานสุดสิ้นลง และถ้ามิได้กำหนดกันไว้เป็นอย่างอื่นในสัญญาแล้ว ท่านว่านายจ้างจำต้องใช้เงินค่าเดินทางขากลับให้ แต่จะต้องเป็นดั่งต่อไปนี้ คือ
* (๑) สัญญามิได้เลิกหรือระงับเพราะการกระทำหรือความผิดของลูกจ้าง และ
