* นอกจากทางแก้ดั่งบัญญัติไว้ในมาตราก่อนนั้น ผู้รับจำนองยังชอบที่จะเรียกเอาทรัพย์จำนองหลุดได้ภายในบังคับแห่งเงื่อนไขดั่งจะกล่าวต่อไปนี้
* (๑) ลูกหนี้ได้ขาดส่งดอกเบี้ยมาแล้วเป็นเวลาถึงห้าปี
* (๒) ผู้จำนองมิได้แสดงให้เป็นที่พอใจแก่ศาลว่าราคาทรัพย์สินนั้นท่วมจำนวนเงินอันค้างชำระ และ
* (๓) ไม่มีการจำนองรายอื่น หรือบุริมสิทธิอื่นได้จดทะเบียนไว้ เหนือทรัพย์สินอันเดียวกันนี้เอง
