* ถ้าผู้รับโอนได้ทำให้ทรัพย์สินซึ่งจำนองเสื่อมราคาลง เพราะการกระทำหรือความประมาทเลินเล่อแห่งตน เป็นเหตุให้เจ้าหนี้ทั้งหลายผู้มีสิทธิจำนอง หรือบุริมสิทธิเหนือทรัพย์สินนั้นต้องเสียหายไซร้ ท่านว่าผู้รับโอนจะต้องรับผิดเพื่อความเสียหายนั้น อย่างไรก็ดี อันผู้รับโอนจะเรียกเอาเงินจำนวนใด ๆ ซึ่งตนได้ออกไป หรือเรียกให้ชดใช้ค่าใช้จ่ายที่ตนได้ทำให้ทรัพย์สินดีขึ้นนั้น ท่านว่า หาอาจจะเรียกได้ไม่ เว้นแต่ที่เป็นการทำให้ทรัพย์สินนั้นงอกราคาขึ้น และจะเรียกได้เพียงเท่าจำนวนราคาที่งอกขึ้นเมื่อขายทอดตลาดเท่านั้น

* The transferee is liable to damages if the property has been made less valuable by his act or negligence, and loss has thereby been suffered by the creditors having mortgages or preferential rights over the same.
