มาตรา 616

• ผู้ขนส่งจะต้องรับผิดในการที่ของอันเขาได้มอบหมายแก่ตนนั้นสูญหาย ฤๅบุบสลาย ฤๅส่งมอบชักช้า เว้นแต่จะพิศูจน์ได้ว่าการสูญหาย ฤๅบุบสลาย ฤๅชักช้านั้น เกิดแต่เหตุสุดวิสัย ฤๅเกิดแต่สภาพแห่งของนั้นเอง ฤๅเกิดเพราะความผิดของผู้ส่งฤๅผู้ตราส่ง

• The carrier is liable for any loss, damage or delay in delivery of the goods entrusted to him, unless he proves that the loss, damage or delay is caused by force majeure or by the nature of the goods, or by the fault of the sender or consignee.
