มาตรา 697

• ถ้าผู้ค้ำประกันไม่อาจเข้ารับช่วงสิทธิของเจ้าหนี้ได้ เพราะเหตุว่าเจ้าหนี้ได้กระทำให้ทรัพย์อันเขาให้ไว้เปนประกันแต่ก่อนฤๅในขณะจะเข้าค้ำประกันชำระหนี้นั้นเสือมเสียฤๅลดราคาไปไซร้ ท่านว่าผู้ค้ำประกันย่อมเปนอันหลุดพ้นจากความรับผิดเพียงเท่าที่ตนต้องรับความเสียหายแต่การนั้น

• If the surety cannot be subrogated to the rights of the creditor, because the latter has impaired or reduced the security which has been given abefore or at the time of suretyship for the performance of the obligation, the surety is discharged to the extent of the injury suffered by him thereby.
