มาตรา 700
- ถ้าค้ำประกันหนี้อันจะต้องชำระ ณ เวลามีกำหนดแน่นอน และเจ้าหนี้ยอมผ่อนเวลาให้แก่ลูกหนี้ไซร้ ท่านว่าผู้ค้ำประกันย่อมหลุดพ้นจากความรับผิด
- แต่ถ้าผู้ค้ำประกันได้ตกลงด้วยในการผ่อนเวลา ท่านว่าผู้ค้ำประกันหาหลุดพ้นจากความรับผิดไม่

- [I] If suretyship has been given for an obligation which is to be performed at a definite time, and the creditor grants to the debtor an extension of time, the surety is discharged.
- [II] The surety is not discharged if he agreed to the extension of time or if the extention is granted by the Court.
