มาตรา 870
- ถ้าได้ทำสัญญาประกันภัยเปนสองรายฤๅกว่านั้นพร้อมกันเพื่อความวินาศภัยอันเดียวกัน และจำนวนเงินซึ่งเอาประกันภัยรวมกันทั้งหมดนั้นท่วมจำนวนที่วินาศจริงไซร้ ท่านว่าผู้รับประโยชน์ชอบที่จะได้รับค่าสินไหมทดแทนเพียงเสมอจำนวนวินาศจริงเท่านั้น
- ผู้รับประกันภัยแต่ละคนต้องใช้เงินจำนวนวินาศจริง แบ่งตามส่วนมากน้อยที่ตนได้รับประกันภัยไว้
- อันสัญญาประกันภัยทั้งหลาย ถ้าลงวันเดียวกัน ท่านให้ถือว่าได้ทำพร้อมกัน

- [I] If two or more contracts of insurance are made simultaneously for the same loss and the total amount of the sum insured exceeds the actual amount of the loss, the beneficiary is entitled to receive compensation up to such amount only.
- [II] Each insurer must pay a part of the actual loss in proportion to the sum insured by him.
- [III] Contracts of insurance are deemed to have been made simultaneously if their dates are the same.
