มาตรา 888

• ถ้าค่าสินไหมทดแทนอันผู้รับประกันภัยได้ใช้ไปโดยคำพิพากษานั้นยังไม่คุ้มค่าวินาศภัยเต็มจำนวนไซร้ ท่านว่าผู้เอาประกันภัยก็ยังคงต้องรับใช้จำนวนที่ยังขาด เว้นไว้แต่บุคคลผู้ต้องเสียหายจะได้ละเลยเสียไม่เรียกตัวผู้เอาประกันภัยเข้ามาสู่คดีด้วยดั่งกล่าวไว้ในมาตราก่อน

• If the compensation paid by the insurer under judgment does not cover the whole amount of the loss, the assured remains liable for the difference unless the injured person has failed to summon the assured to appear in the action as provided by the foregoing Section.
