มาตรา 990

• ผู้ทรงเช็คต้องยื่นเช็คแก่ธนาคารเพื่อให้ใช้เงิน คือว่าถ้าเปนเช็คให้ใช้เงินในเมืองเดียวกันกับที่ออกเช็ค ต้องยื่นภายในเดือนหนึ่งนับแต่วันออกเช็คนั้น ถ้าเปนเช็คให้ใช้เงินที่อื่น ต้องยื่นภายในสามเดือน ถ้ามิฉนั้นท่านว่าผู้ทรงสิ้นสิทธิที่จะไล่เบี้ยเอาแก่ผู้สลักหลังทั้งปวง ทั้งเสียสิทธิอันมีต่อผู้สั่งจ่ายด้วยเพียงเท่าที่จะเกิดความเสียหายอย่างหนึ่งอย่างใดแก่ผู้สั่งจ่าย เพราะการที่ละเลยเสียไม่ยื่นเช็คนั้น
• อนึ่ง ผู้ทรงเช็คซึ่งผู้สั่งจ่ายหลุดพ้นจากความรับผิดไปแล้วนั้น ท่านให้รับช่วงสิทธิของผู้สั่งจ่ายคนนั้นอันมีต่อธนาคาร

• [I] The holder of a cheque must present it for payment to the banker within one month after the date of issue if it is payable in the same town where it is issued, or within three months if it is payable elsewhere; otherwise he loses his right of recourse against the indorsers; he also loses his right against the drawer to the extent of any injury caused to the drawer by failure of such presentment.
• [II] The holder of such cheque as to which such drawer is discharged shall be subrogated to the rights of such drawer against the banker.
