มาตรา 1000

• ธนาคารใดได้รับเงินไว้เพื่อผู้เคยค้าของตนโดยสุจริตและปราศจากประมาทเลินเล่อ อันเปนเงินเขาใช้ให้ตามเช็คขีดคร่อมทั่วไปก็ดี ขีดคร่อมเฉภาะให้แก่ตนก็ดี หากปรากฏว่าผู้เคยค้านั้นไม่มีสิทธิ ฤๅมีสิทธิเพียงอย่างบกพร่องในเช็คนั้นไซร้ ท่านว่าเพียงแต่เหตุที่ได้รับเงินไว้หาทำให้ธนาคารนั้นต้องรับผิดต่อผู้เปนเจ้าของอันแท้จริงแห่งเช็คนั้นแต่อย่างหนึ่งอย่างใดไม่

• Where a banker in good faith and without negligence receives payment for a customer of a cheque crossed generally or specially to himself, and the customer has no title or a defective title thereto, the banker shall not incur any liability to the true owner of the cheque by reason only of having received such payment.
