มาตรา 1041

• ถ้าผู้เปนหุ้นส่วนคนใดคนหนึ่งโอนส่วนกำไรของตนในห้างหุ้นส่วนทั้งหมดก็ดี ฤๅแต่บางส่วนก็ดี ให้แก่บุคคลภายนอกโดยมิได้รับความยินยอมของผู้เปนหุ้นส่วนทั้งหลายอื่นไซร้ ท่านว่าบุคคลภายนอกนั้นจะกลายเปนเข้าหุ้นส่วนด้วยก็หามิได้

• If a partner, without the consent of the other partners, transfers to a third person the whole or part of his share in the profits of the partnership, such third person does not become a partner.
