มาตรา 123

• ถ้ากลฉ้อฉลนั้นเป็นแต่เพียงเหตุ กล่าวคือว่าเพียงได้จูงใจให้คู่กรณีฝ่ายหนึ่งยอมรับเอาซึ่งข้อกำหนดอันหนักยิ่งกว่าที่เขาจะยอมรับโดยปกติไซร้ ท่านว่าคู่กรณีฝ่ายนั้นได้แต่จะเรียกเอาค่าสินไหมทดแทน จะบอกล้างการอันนั้นเสียทีเดียวหาได้ไม่

• If the fraud is only incidental, that is to say, it has merely induced a party to accept more onerous terms than would otherwise have done, such party can only claim compensation for damage and cannot avoid the act.
