- ตราบใดการชำระหนี้นั้นยังมิได้กระทำลงเพราะพฤติการณ์อันใดอันหนึ่งซึ่งลูกหนี้ไม่ต้องรับผิดชอบ ตราบนั้นลูกหนี้ยังหาได้ชื่อว่าผิดนัดไม่
