มาตรา 681
- อันค้ำประกันนั้น จะมีได้แต่เฉภาะเพื่อหนี้อันสมบูรณ์
- หนี้ในอนาคดตฤๅหนี้มีเงื่อนไข จะประกันไว้เพื่อเหตุการณ์ซึ่งหนี้นั้นอาจเปนผลได้จริง ก็ประกันได้
- หนี้อันเกิดแต่สัญญาซึ่งไม่ผูกพันลูกหนี้ เพราะทำด้วยความสำคัญผิด ฤๅเพราะเปนผู้ไร้ความสามารถนั้น ก็อาจจะมีประกันอย่างสมบูรณ์ได้ ถ้าหากว่าผู้ค้ำประกันรู้เหตุสำคัญผิดฤๅไร้ความสามารถนั้นในขณะที่เข้าสัญญาผูกพันตน

- [I] Suretyship can be given only for a valid obligation.
- [II] A future or conditional obligation may be secured for the event in which it would have effect.
- [III] An obligation, resulting from a contract which under mistake or incapacity does not bind the debtor, can be validly secured if the surety at the time when he binds himself knows such mistake or incapacity.
