มาตรา 940
- ผู้รับอาวัลย่อมต้องผูกพันเปนอย่างเดียวกันกับบุคคลซึ่งตนประกัน
- แม้ถึงว่าความรับผิดใช้เงินอันผู้รับอาวัลได้ประกันอยู่นั้นจะตกเปนใช้ไม่ได้ด้วยเหตุใด ๆ นอกจากเพราะทำผิดแบบระเบียบ ท่านว่าข้อที่สัญญารับอาวัลนั้นก็ยังคงสมบูรณ์
- เมื่อผู้รับอาวัลได้ใช้เงินไปตามตั๋วแลกเงินแล้ว ย่อมได้สิทธิในอันจะไล่เบี้ยเอาแก่บุคคลซึ่งตนได้ประกันไว้ กับทั้งบุคคลทั้งหลายผู้รับผิดแทนตัวผู้นั้น

- [I] The giver of an Aval is bound in the same manner as the person whom he guarantees.
- [II] His engagement is valid even when the liability which he has guaranteed is inoperative for any reason other than defect of form.
- [III] He has, when he pays the bill of exchange, the right of recourse against the person whom he has guaranteed, and the persons responsible for the latters.
