มาตรา 968

• ผู้ทรงตั๋วแลกเงินชอบที่จะเอาเงินใช้จากบุคคลซึ่งตนใช้สิทธิไล่เบี้ยนั้นก็ได้ คือ
  • (๑) จำนวนเงินในตั๋วแลกเงินซึ่งเขาไม่รับรองฤๅไม่ใช้กับทั้งดอกเบี้ยด้วย หากว่ามีข้อกำหนดไว้ว่าให้คิดดอกเบี้ย
  • (๒) ดอกเบี้ยอัตราร้อยละห้า นับแต่วันตั๋วเงินถึงกำหนด
  • (๓) ค่าใช้จ่ายในการคัดค้าน และในการส่งคำบอกกล่าวของผู้ทรงไปยังผู้สลักหลังถัดจากตนและผู้สั่งจ่าย กับทั้งค่าใช้จ่ายอื่น ๆ
  • (๔) ค่าชักส่วนลดซึ่งถ้าไม่มีข้อตกลงกันไว้ ท่านให้คิดร้อยละ ๑/๖ ในต้นเงินอันจะพึงใช้ตามตั๋วเงิน และไม่ว่ากรณีจะเปนอย่างไร ท่านมิให้คิดสูงกว่าอัตรานี้
• ถ้าใช้สิทธิไล่เบี้ยก่อนตั๋วเงินถึงกำหนด ท่านให้หักลดจำนวนเงินในตั๋วเงินลงให้ร้อยละห้า

• [I] The holder may recover from the person against whom he exercises his right of recourse:
  • (1) The amount of the unaccepted or unpaid bill of exchange with interest, if interest has been stipulated for.
  • (2) Interest at the rate of 5 per cent from the date of maturity.
  • (3) The expenses of protest and of the notices given by the holder to his immediate indorser and the drawer, as well as other expenses.
  • (4) A commission which, in default of an agreement, shall be 1/6th. per cent on the principal payable by the bill, and which in no case can exceed this rate.
• [II] If the right of recourse is exercised before maturity, the amount of the bill shall be subject to a discount of 5 per cent.
