มาตรา 405
- บทบัญญัติทั้งหลายที่กล่าวมาในสิบมาตราก่อนนั้น ท่านมิให้ใช้บังคับแก่กรณีที่บุคคลหนึ่งเข้าทำการงานของผู้อื่นโดยสำคัญว่าเป็นการงานของตนเอง
- ถ้าบุคคลใดถือเอากิจการของผู้อื่นว่าเป็นของตนเอง ทั้งที่รู้แล้วว่าตนไม่มีสิทธิจะทำเช่นนั้นไซร้ ท่านว่าตัวการจะใช้สิทธิเรียกร้องบังคับโดยมูลดั่งบัญญัติไว้ในมาตรา ๓๙๕, ๓๙๖, ๓๙๙ และ ๔๐๐ นั้นก็ได้ แต่เมื่อได้ใช้สิทธิดั่งว่ามานี้แล้ว ตัวการจะต้องรับผิดต่อผู้จัดการดั่งบัญญัติไว้ในมาตรา ๔๐๒ วรรค ๑

- [I] The provisions of the ten foregoing sections do not apply, if a person takes charge of the affair of another in the belief that it is his own.
- [II] If a person treats the affair of another as his own, although knowing that he is not entitled to do so, the principal may enforce the claims based on sections 395, 396, 399 and 400. If he does enforce them, he is liable to the manager as provided for in Section 402, paragraph 1.

The most plausible model for this section would be:
- German Civil Code (1896), Sec.687;
- [I] The provisions of 677 to 686 do not apply, if a person takes charge of the affair of another in the belief that it is his own.
- [II] If a person treats the affair of another as his own, although knowing that he is not entitled to do so, the principal may enforce the claims based on 677, 678, 681, 682. If he does enforce them, he is liable to the agent as provided for in 684, sentence 1.
