มาตรา 438
- ค่าสินไหมทดแทนจะพึงใช้โดยสถานใดเพียงใดนั้น ให้ศาลวินิจฉัยตามควรแก่พฤติการณ์และความร้ายแรงแห่งละเมิด
- อนึ่ง ค่าสินไหมทดแทนนั้นได้แก่การคืนทรัพย์สินอันผู้เสียหายต้องเสียไปเพราะละเมิด หรือใช้ราคาทรัพย์สินนั้น รวมทั้งค่าเสียหายอันจะพึงบังคับให้ใช้เพื่อความเสียหายอย่างใดๆ อันได้ก่อขึ้นนั้นด้วย
Section 438. (Draft in English from Vol.79)
- [I] The Court shall determine the manner and the extent of the compensation according to the circumstances and the gravity of the wrongful act.
- [II] Compensation may include restitution of the property of which the injured person has been wrongfully deprived or its value as well as damages for any injury caused.

This section would be a compound provision from two different models as follows:
- [Primary model] Schweizerisches Obligationenrecht (1911), Art.43;
- [I] Art und Größe des Ersatzes für den eingetretenen Schaden bestimmt der Richter, der hiebei sowohl die Umstände als die Größe des Verschuldens zu würdigen hat.
- [II] Wird Schadenersatz in Gestalt einer Rente zugesprochen, so ist der Schuldner gleichzeitig zur Sicherheitsleistung anzuhalten.

- สินไหมทดแทนนั้น ท่านบังคับไว้ว่ามีประการดังนี้
- (๑) คืนทรัพย์สิน ฤๅใช้ราคาทรัพย์สินอันเขาต้องเสียหายไปเพราะการละเมิด และ
- (๒) ใช่สินไหมทดแทนเพื่อความเสียหายอันเกิดแก่เขา
- สินไหมทดแทนนั้น ท่านบังคับไว้ว่ามีประการดังนี้
