Chapter VII. Particular Kinds of Obligations.

Title XVI. Annuities.

  • [I] A person who is bound to provide an annuity shall, in case of doubt, pay the annuity for the lifetime of the annuitant.
  • [II] The amount specified for the annuity is, in case of doubt, the yearly amount of the annuity.
  • [I] The annuity is payable in advance.
  • [II] A money annuity is payable in advance by quarterly instalments; as regards any other kind of annuity the period of time for which it shall be paid in advance is determined according to the nature and object of the annuity.
  • [III] If the annuitant was alive at the beginning of the period for which the annuity is to be paid in advance, the whole amount due for the period accrues to him.
  • For the validity of a contract whereby an annuity is promised the promise is required to be in writing, unless some other form is prescribed.
