มาตรา 760
- ถ้าผู้รับจำนำเอาทรัพย์สินซึ่งจำนำออกใช้เอง หรือเอาไปให้บุคคลภายนอกใช้สอยหรือเก็บรักษา โดยผู้จำนำมิได้ยินยอมด้วยไซร้ ท่านว่าผู้รับจำนำจะต้องรับผิดเพื่อที่ทรัพย์สินจำนำนั้นสูญหายหรือบุบสลายไปอย่างใด ๆ แม้ทั้งเป็นเพราะเหตุสุดวิสัย เว้นแต่จะพิสูจน์ได้ว่า ถึงอย่างไร ๆ ก็คงจะต้องสูญหายหรือบุบสลายอยู่นั่นเอง

- If, without the consent of the pledgor, the pledgee uses the pledged property or lets a third person have the use or custody of it, he is liable for any loss or damage to the pledged property, even caused by force majeure, unless he proves that the loss or damage would have happened in any case.
