มาตรา 763
- ท่านห้ามมิให้ฟ้องคดีดั่งจะกล่าวต่อไปนี้ เมื่อพ้นหกเดือนนับแต่วันส่งคืนหรือขายทอดตลาดทรัพย์สินจำนำ คือ
- (๑) ฟ้องเรียกค่าสินไหมทดแทน เพื่อความบุบสลายอันผู้รับจำนำก่อให้เกิดแก่ทรัพย์สินจำนำ
- (๒) ฟ้องเรียกให้ชดใช้ค่าใช้จ่าย เพื่อการบำรุงรักษาทรัพย์สินจำนำ
- (๓) ฟ้องเรียกค่าสินไหมทดแทน เพื่อความเสียหายอันเกิดแก่ผู้รับจำนำ เพราะความชำรุดบกพร่องในทรัพย์สินจำนำซึ่งไม่เห็นประจักษ์
Section 763. (Draft in English from Vol.93)
- The following actions cannot be entered later than six months after the return or sale by auction of the pledged property:
- (1) An action for compensation for damage caused to the pledged property by the pledgee.
- (2) An action for reimbursement of expenses incurred for the preservation or maintenance of the pledged property.
- (3) An action for compensation for injury caused to the pledgee by non-apparent defects in the pledged property.
