มาตรา 100
  • อสังหาริมทรัพย์ ได้แก่ที่ดินกับทรัพย์อันติดอยู่กับที่ดินนั้น หรือประกอบเป็นอันเดียวกับที่ดินนั้น อนึ่งคำว่าอสังหาริมทรัพย์ ท่านหมายรวมถึงสิทธิทั้งหลายอันเกี่ยวกับกรรมสิทธิ์ในที่ดินด้วย

  • Immovable property denotes land and things fixed to land or forming a body therewith. It includes real rights connected with ownership of land.

This section would be a compound provision from two different models as follows:

  • [Primary model] Japanese Civil Code (1896,98), Art.86:
    • [I] Land and the things fixed thereto are immovables.
    • [II] All other things are movables.
    • [III] Obligations performable to bearer are considered as movables.
  • [Secondary model] German Civil Code (1896), Sec.96:
    • Rights which are connected with the ownership of land are deemed to be component parts of the land.

  • Swiss Civil Code (1907), Art.667:
    • [I] Ownership in land and soil reaches above and underneath into the air and the earth so far as the exercise of the ownership requires.
    • [II] It embraces all buildings and plants as well as springs, subject to the legal restrictions.
