มาตรา 192
  • ประโยชน์แห่งอายุความนั้น จะอาจละเสียได้ต่อเมื่ออายุความครบบริบูรณ์แล้ว แต่การที่ละเสียเช่นนี้ไม่ย่อมลบล้างสิทธิของบุคคลภายนอก
  • อนึ่งการที่ลูกหนี้ชั้นต้นละเสียซึ่งอายุความนั้น ย่อมไม่ลบล้างสิทธิของผู้ค้ำประกัน

  • [I] The benefit of prescription can be waived only after it has been completed, but such waiver does not prejudice the right of third persons.
  • [II] The waiver of prescription by the principal debtor does not prejudice the surety.

This section would be a compound provision from two different models as follows:

  • [Primary model] Civil Code of Brazil (1916), Art.161;
    • [I] The waiver (renuncia) of prescription may be express or tacit, and it will only be effective (só valerá) when made, without prejudice of third persons, after the prescription is consummated.
    • [II] The waiver is tacit when it is presumed from acts (factos) of the interested party incompatible with the prescription.
  • [Secondary model] Japanese Civil Code (1896/98), Art.146;
    • The benefit of prescription cannot be renounced (waived) in advance.
  • [Third model] German Civil Code (1896), Sec.768;
    • [I] A surety may set up all defences belonging to the principal debtor. If the principal debtor dies the surety may not avail himself of the fact that the heir has only a limited liability for the obligation.
    • [II] The surety does not lose a defence by reason of the fact that the principal debtor has waived it.

The other miscellaneous sources are as follows:

  • French Civil Code (1804), Art.2220:
    • Prescription cannot be renounced by anticipation ; prescription acquired may be renounced.
  • Schweizerisches Obligationenrecht (1911), Art.141:
    • [I] Auf die Verjährung kann nicht zum voraus verzichtet werden.
    • [II] Der Verzicht eines Solidarschuldners kann den übrigen Solidarschuldnern nicht entgegen gehalten werden.
    • [III] Dasselbe gilt unter mehreren Schuldnern einer unteilbaren Leistung und für den Bürgen beim Verzicht des Hauptschuldners.
