- อันว่าแลกเปลี่ยนนั้น คือสัญญาซึ่งคู่กรณีต่างยกทรัพย์สินสิ่งหนึ่งสิ่งใดให้แก่กัน เพื่อได้ทรัพย์สินสิ่งอื่นมาแทน
