มาตรา 277

• เมื่อมีบุริมสิทธิสามัญหลายรายแย้งกัน ท่านให้ถือว่าบุริมสิทธิทั้งหลายนั้นมีลำดับที่จะให้ผลก่อนหลัง ดังที่ได้เรียงลำดับไว้ในมาตรา ๒๕๓
• เมื่อมีบุริมสิทธิสามัญแย้งกับบุริมสิทธิพิเศษ ท่านว่าบุริมสิทธิพิเศษย่อมอยู่ในลำดับก่อน แต่บุริมสิทธิในมูลค่าใช้จ่ายเพื่อประโยชน์ร่วมกันนั้น ย่อมอยู่ในลำดับก่อน ในฐานที่จะใช้สิทธินั้นต่อเจ้าหนี้ผู้ได้รับประโยชน์จากการนั้นหมดทุกคนด้วยกัน

• [I] When general preferential rights conflict, the rank of their precedence is according to the order in Section 252.
• [II] When a preferential right conflicts with a special preferential right, the latter takes precedence; but the preferential rights on account of expenses for the common benefit takes precedence as against all creditors who are benefited thereby.

• Japanese Civil Code (1896/98), Art.329;
  • [I] In case general preferential rights conflict with each other, the ranks of such preferential rights are determined according to the order mentioned in Art. 306.
  • [II] In case a general preferential right conflicts with a special preferential right the latter takes precedence over the former; but the preferential right for expenses for the common benefit has validity of preference against all the creditors who have benefited by them.
