มาตรา 344
- สิทธิเรียกร้องใดยังมีข้อต่อสู้อยู่ สิทธิเรียกร้องนั้น ท่านว่าหาอาจจะเอามาหักกลบลบหนี้ได้ไม่ อนึ่ง อายุความย่อมไม่ตัดรอนการหักกลบลบหนี้ แม้สิทธิเรียกร้องขาดอายุความแล้ว แต่ว่าในเวลาที่อาจจะหักกลบลบกับสิทธิเรียกร้องฝ่ายอื่นได้นั้น สิทธิยังไม่ขาด

- A claim against which there is a defence may not be set off. Prescription does not exclude set off, if the claim barred by prescription was not barred at the time at which it could have been set off against the other claim.

- German Civil Code (1896), Sec.390;
