มาตรา 805

• ในกิจการอันหนึ่งอันเดียกัน ผู้ใดเปนตัวแทนของฝ่ายหนึ่งอยู่แล้ว ท่านว่าจะไปเปนต้วแทนของอีกฝ่ายหนึ่งไม่ได้ ฤๅจะเปนตัวแทนของคู่กรณีทั้งสองฝ่ายด้วยกันก็ไม่ได้
