มาตรา 1266

• ถ้าผู้ชำระบาญชีมาพิจารณาเห็นว่า เมื่อเงินลงทุนฤๅเงินค่าหุ้นได้ใช้เสร็จหมดแล้ว สินทรัพย์ก็ยังไม่พอกับหนี้สินไซร้ ผู้ชำระบาญชีต้องร้องขอต่อศาลทันที เพื่อให้ออกคำสั่งว่าห้างหุ้นส่วนฤๅบริษัทนั้นล้มละลาย

• If the liquidators find that after the whole of the contributions or shares has been paid up, the assets are insufficient to meet the liabilities, they must apply at once to the Court to have the partnership or company declared bankrupt.
