มาตรา 326
- บุคคลผู้ชำระหนี้ชอบที่จะได้รับใบเสร็จเป็นสำคัญจากผู้รับชำระหนี้นั้น และถ้าหนี้นั้นได้ชำระหนี้สิ้นเชิงแล้ว ผู้ชำระหนี้ชอบที่จะได้รับเวนคืนเอกสารอันเป็นหลักฐานแห่งหนี้ หรือให้ขีดฆ่าเอกสารนั้นเสีย ถ้าและเอกสารนั้นสูญหาย บุคคลผู้ชำระหนี้ชอบที่จะให้จดแจ้งความข้อระงับหนี้ลงไว้ในใบเสร็จหรือในเอกสารอีกฉบับหนึ่งต่างหากก็ได้
- ถ้าหนี้นั้นได้ชำระแต่บางส่วนก็ดี หรือถ้าเอกสารนั้นยังให้สิทธิอย่างอื่นใดแก่เจ้าหนี้อยู่ก็ดี ท่านว่าลูกหนี้ชอบแต่ที่จะได้รับใบเสร็จไว้เป็นคู่มือและให้จดแจ้งการชำระหนี้นั้นลงไว้ในเอกสาร
Section 326. (Draft in English from Vol.79)
- [I] The person making performance is entitled to a receipt from the person who receives performance, and if the performance is wholly performed, he is entitled to have the document embodying the obligation surrendered to him or cancelled. If such document is declared to be lost, he is entitled to have the extinction of the obligation mentioned in the receipt or in a separate document.
- [II] If the obligation is partly performed or if the document gives the creditor any other right, the debtor is only entitled to a receipt and to the performance noted in the document.

- [I] Der Schuldner, der eine Zahlung leistet, ist berechtigt, eine Quittung und, falls die Schuld vollständig getilgt wird, auch die Rückgabe des Schuldscheines oder dessen Entkräftung zu fordern.
- [II] Ist die Zahlung keine vollständige oder sind in dem Schuldscheine auch andere Rechte des Gläubigers beurkundet, so kann der Schuldner außer der Quittung nur die Vormerkung auf dem Schuldscheine verlangen.
