มาตรา 187
- ผู้ใดก่อเหตุให้เสียหายแก่บุคคลผู้หนึ่งเพราะทำผิดร้ายเป็นความอาญาก็ดี เพราะทำฝ่าฝืนบทกฎหมาย ฤๅกฎ ฤๅคำสั่งอันชอบตัวกฎหมายประการหนึ่งประการใดก็ดี ท่านว่าผู้นั้นทำละเมิด จำต้องใช้ค่าสินไหมทดแทนให้แก่ผู้ต้องเสียหาย มิพักจะต้องคำนึงว่าผู้นั้นจะต้องโทษฤๅมิต้องโทษตามกฎหมายอาญานั้นเลย
