มาตรา 460
- ในการซื้อขายทรัพย์สินซึ่งมิได้กำหนดลงไว้แน่นอนนั้น ท่านว่ากรรมสิทธิ์ยังไม่โอนไปจนกว่าจะได้หมาย หรือนับ ชั่ง ตวง วัด หรือคัดเลือก หรือทำโดยวิธีอื่นเพื่อให้บ่งตัวทรัพย์สินนั้นออกเป็นแน่นอนแล้ว
- ในการซื้อขายทรัพย์สินเฉพาะสิ่ง ถ้าผู้ขายยังจะต้องนับ ชั่ง ตวง วัด หรือทำการอย่างอื่น หรือทำสิ่งหนึ่งสิ่งใดอันเกี่ยวแก่ทรัพย์สินเพื่อให้รู้กำหนดราคาทรัพย์สินนั้นแน่นอน ท่านว่ากรรมสิทธิ์ยังไม่โอนไปยังผู้ซื้อจนกว่าการหรือสิ่งนั้นได้ทำแล้ว

- [I] In case of sale of unascertained property, the ownership is not transferred until the property has been numbered, counted, weighed, measured or selected, or its identity has been otherwise rendered certain.
- [I] In case of sale of specific property, if the seller is bound to count, weigh, measure or do some other act or thing with reference to the property for the purpose of ascertaining the price, the ownership is not transferred to the buyer until such act or thing be done.

- Sec. 16.
- Where there is a contract for the sale of unascertained goods no property in the goods is transferred to the buyer unless and until the goods are ascertained.
- Sec. 18. Rule 3.
- Where there is a contract for the sale of specific goods in a deliverable state, but the seller is bound to weigh, measure, test, or do some other act or thing with reference to the goods for the purpose of ascertaining the price, the property does not pass until such act or thing be done, and the buyer has notice thereof.
