มาตรา 660
- ถ้าผู้ฝากมิได้อนุญาต และผู้รับฝากเอาทรัพย์สินซึ่งฝากนั้นออกใช้สอยเอง หรือเอาไปให้บุคคลภายนอกใช้สอย หรือให้บุคคลภายนอกเก็บรักษาไซ้ร ท่านว่าผู้รับฝากจะต้องรับผิดเมื่อทรัพย์สินซึ่งฝากนั้นสูญหายหรือบุบสลายอย่างอนึ่งอย่างใด แม้ถึงจะเป็นเพราะเหตุสุดวิสัย เว้นแต่จะพิสูจน์ได้ว่า ถึงอย่างไร ๆ ทรัพย์สินนั้นก็คงจะต้องสูญหายหรือบุบสลายอยู่นั่นเอง

- If without the permission of the depositor the depositary uses the property deposited or lets a third person have the use or custody of it, he is liable for any loss or damage to the property, even caused by force majeure, unless he proves that the loss or damage would have happened in any case.
