มาตรา 723
- ถ้าทรัพย์สินซึ่งจำนองบุบสลาย หรือถ้าทรัพย์สินซึ่งจำนองแต่สิ่งใดสิ่งหนึ่งสูญหายหรือบุบสลาย เป็นเหตุให้ไม่เพียงพอแก่การประกันไซร้ ท่านว่าผู้รับจำนองจะบังคับจำนองเสียในทันทีก็ได้ เว้นแต่เมื่อเหตุนั้นมิได้เป็นเพราะความผิดของผู้จำนอง และผู้จำนองก็เสนอจะจำนองทรัพย์สินอื่นแทนให้มีราคาเพียงพอ หรือเสนอจะรับซ่อมแซมแก้ไขความบุบสลายนั้นภายในเวลาอันสมควรแก่เหตุ

- If the mortgaged property is damaged, or if one of the mortgaged properties is lost or damaged, so that the security becomes insufficient, the mortgagee may enforce the mortgage at once, unless the mortgagor has not been at fault and offers either to mortgage another property of sufficient value or to repair the damage within a reasonable time.
