มาตรา 744
- อันจำนองย่อมระงับสิ้นไป
- (๑) เมื่อหนี้ที่ประกันระงับสิ้นไป ด้วยเหตุประการอื่นใด มิใช่เหตุอายุความ
- (๒) เมื่อปลดจำนองให้แก่ผู้จำนองด้วยหนังสือเป็นสำคัญ
- (๓) เมื่อผู้จำนองหลุดพ้น
- (๔) เมื่อถอนจำนอง
- (๕) เมื่อขายทอดตลาดทรัพย์สินซึ่งจำนองตามคำสั่งศาล อันเนื่องมาแต่การบังคับจำนองหรือถอนจำนอง
- (๖) เมื่อเอาทรัพย์สินซึ่งจำนองนั้นหลุด
Section 744. (Draft in English from Vol.93)
- A mortgage is extinguished:
- (1) By extinction of the obligation secured, otherwise than by prescription.
- (2) By release of the mortgage granted in writing to the mortgagor.
- (3) By the mortgagor being discharged.
- (4) By the mortgage being removed.
- (5) By auction sale of the mortgaged property by order of the Court as a result of enforcement or removal of mortgage.
- (6) By foreclosure of the mortgage.
