มาตรา 338
  • ในคดีระหว่างเจ้าหนี้และลูกหนี้นั้น ถ้าการไม่ชำระหนี้เกิดเพราะบุคคลผู้ซึ่งลูกหนี้หรือเจ้าหนี้ไม่ต้องรับผิดชอบไซร้ ให้ถือว่าการไม่ชำระหนี้นั้นเกิดเพราะเหตุสุดวิสัย
