มาตรา 561
- ถ้ามิได้ทำหนังสือลงลายมือชื่อของคู่สัญญาแสดงไว้ต่อกันว่าทรัพย์สินที่ให้เช่ามีสภาพเปนอยู่อย่างไร ท่านให้สันนิฐานไว้ก่อนว่าผู้เช่าได้รับทรัพย์สินที่เช่านั้นไปโดยสภาพอันซ่อมแซมดีแล้ว และเมื่อเลิกสัญญา ฤๅสัญญาระงับไป ผู้เช่าก็ต้องส่งคืนทรัพย์สินในสภาพเช่นนั้น เว้นแต่จะพิสูจน์ได้ว่าทรัพย์สินนั้นมิได้ซ่อมแซมไว้ดีในขณะที่ส่งมอบ

- If no written description of the condition of the property hired has been made and signed by both parties, the hirer is presumed to have received the property in a good state of repair and he must return the property in such condition at the determination or extinction of the contract unless he can prove that it was out of repair at the time of delivery.
