มาตรา 853
- อันการพนันฤๅขันต่อนั้น ท่านว่าหาก่อให้เกิดหนี้ไม่ สิ่งที่ได้ให้กันไปในการพนันฤๅขันต่อก็จะทวงคืนไม่ได้ เพราะเหตุหามูลหนี้อย่างหนึ่งอย่างใดมิได้
- ข้อบัญญัติที่กล่าวนี้ ท่านให้ใช้ตลอดถึงข้อตกลงเปนมูลหนี้อย่างหนึ่งอย่างใดอันฝ่ายข้างเสียพนันขันต่อหากทำให้แก่อีกฝ่ายหนึ่งเพื่อจะใช้หนี้เงินพนันฤๅขันต่อนั้นด้วย

- [I] No obligation is created by gambling or betting. What has been given by reason of the gambling or betting may not be demanded back on the ground that no obligation existed.
- [II] These provisions apply also to an agreement whereby the losing party, for the purpose of satisfying a gambling debt or a bet, incurs an obligation towards the other party.
