มาตรา 861
- อันว่าสัญญาประกันภัยนั้น คือสัญญาซึ่งบุคคลหนึ่งตกลงจะใช้ค่าสินไหมทดแทน ฤๅใช้เงินจำนวนหนึ่งให้ในกรณีวินาศภัยหากมีขึ้น ฤๅในเหตุอย่างอื่นในอนาคตดังได้ระบุไว้ในสัญญา และในการนี้บุคคลอีกคนหนึ่งตกลงจะส่งเงินซึ่งเรียกว่า เบี้ยประกันภัย

- A contract of insurance is where a person agrees to make compensation or to pay a sum of money in case of contingent loss or any other future event specified in the contract, and another person agrees to pay therefor a sum of money, called premium.
