มาตรา 101
  • สังหาริมทรัพย์ ได้แก่ทรัพย์ทั้งหลายอันอาจขนเคลื่อนจากแห่งหนึ่งไปแห่งอื่นได้ ไม่ว่าเคลื่อนด้วยแรงเดินแห่งตัวทรัพย์นั้นเอง หรือเคลื่อนด้วยกำลังภายนอก อนึ่งคำว่าสังหาริมทรัพย์ ท่านหมายความถึงกำลังแรงแห่งธรรมชาติอันอาจถือเอาได้ และทั้งสิทธิทั้งหลายอันเกี่ยวด้วยสังหาริมทรัพย์ด้วย

  • Movable property denotes things which can be carried from one place to another, whether moving by their own motion, or being moved by an external force. It includes forces of nature susceptible of appropriation as well as rights connected with movables.

This section would be a compound provision from two different models as follows:

  • [Primary model] Civil Code of Argentina (1871), Art.2352:
    • Movable things are those which can be carried from one place to another, whether moving by their own motion, or being moved by an external force, with the exception of those which are accessory to immovables.
  • [Secondary model] Swiss Civil Code (1907), Art.713:
    • Subject to ownership as movables are those corporeal things, movable by their nature, as well as the forces of nature which can be brought under legal control and do not belong to land.
