Section 117. (Draft in English from Vol.79)

  • A declaration of intention is not void on the ground that the declarant in the recesses of his mind does not intend to be bound by his expressed intention, unless this hidden intention was known to the other party.

《Comments》

The most plausible model for this section would be:

  • German Civil Code (1896), Sec.116:
    • A declaration of intention is not void by reason of the fact that the declarant has made a secret reservation of not willing the matter declared. The declaration is void if made to a person who is aware of the reservation.
