《Comments》

The most plausible model for this section would be:

  • Japanese Civil Code (1896/98), Art.520;
    • When the rights and duties of an obligation are vested in the same person, the obligation is extinguished, except when it has become the subject of the right of a third person.

The other miscellaneous sources are as follows:

  • French Civil Code (1804), Art.130;
    • When the characters of debtor and creditor are united in the same person, a confusion arises by law which extinguishes the two claims.
  • Schweizerisches Obligationenrecht (1911), Art.118;
    • [I] Wenn die Eigenschaften des Gläubigers und des Schuldners in einer Person zusammentreffen, so gilt die Forderung als durch Vereinigung erloschen.
    • [II] Wird die Vereinigung rückgängig, so lebt die Forderung wieder auf.
    • [III] Vorbehalten bleiben die besondern Vorschriften über das Grundpfandrecht und die Wertpapiere.
