มาตรา 367
- สัญญาใดคู่สัญญาได้ถือว่าเป็นอันได้ทำกันขึ้นแล้ว แต่แท้จริงยังมิได้ตกลงกันในข้อหนึ่งข้อใด อันจะต้องทำความตกลงให้สำเร็จ ถ้าจะพึงอนุมานได้ว่า ถึงหากจะไม่ทำความตกลงกันในข้อนี้ได้สัญญานั้นก็จะได้ทำขึ้นไซร้ ท่านว่าข้อความส่วนที่ได้ตกลงกันแล้วก็ย่อมเป็นอันสมบูรณ์

- If the parties to a contract, which they regarded as concluded, have in fact not agreed as to one point upon which an agreement was to be settled, those parts which were agreed upon are valid in so far as it may be inferred that the contract would have been concluded even without a settlement of this point.

The most plausible model for this section would be:
- German Civil Code (1896), Sec.155;
- If the parties to a contract which they regard as concluded have in fact not agreed upon one point concerning which an agreement should have been arrived at, that which is agreed upon is valid if it is to be inferred that the contract would have been concluded even without a settlement of this point.
