มาตรา 376
- ข้อต่อสู้อันเกิดแต่มูลสัญญาดังกล่าวมาในมาตรา ๓๗๔ นั้น ลูกหนี้อาจจะยกขึ้นต่อสู้บุคคลภายนอกผู้จะได้รับประโยชน์จากสัญญานั้นได้

- Defences arising from the contract mentioned in Section 374 can be set up by the debtor against the third person who receive the benefit of the contract.

The most plausible model for this section would be:
- Japanese Civil Code (1896/98), Art.539;
- Any plea or defence which is founded on the contract mentioned in Art. 537 can be set up by the debtor against the third person who is to enjoy the benefit of the said contract.
